Hao TieChuan: Trias Politica Doesn’t Exist in HK

郝鐵川:香港並非三權分立

Hao TieChuan, director of publicity, culture and sports affairs at China Liaison Office, said that Hong Kong’s political structure does not follow the Trias Politica model, and he also emphasised that China Central Government has sovereignty and governance over Hong Kong.

In a commentary in a Hong Kong newspaper, Hao, byline as a guest lecturer of Shue Yan University,  said that Hong Kong’s legislature, executive branch and judiciary do not have independent and complete power as those in the United States, because Hong Kong is a local political power under China’s Central Government. He also said that China’s Central Government has sovereignty as well as governance over Hong Kong.

Hao also said that Hong Kong adopts the executive dominance system but not Trias Politica modeal, hence the Chief Executive’s legal state is higher than the legislature and has more power than the legislature. China Central Government also enjoys part of Hong Kong’s legislative power. The Legislative Council can propose a bill to impeach the Chief Executive, but the decision is ultimately made by China’s Central Government.
